1. Acceptance and scope of application

1.2 By placing an order, the customer agrees to the general terms and conditions of the supplier.
You can contact our Dutch customer service by e-mail info@daysy.nl or chat at daysy.nl. Patricia Dijkema will answer messages. As she has moved to Bulgaria, her business has also moved. But all shipping and support will continue as you were/are used to.

2. Offer and conclusion of purchase
2.1 The presentation of products in the online shop does not represent a legally binding offer, but an invitation to place orders and is subject to errors.
2.2 Information, descriptions and explanations on the website are non-binding unless the supplier has expressly described them as a written commitment.
2.3 By clicking on the "order" button in the online shop, the customer sends a binding order for the products listed on the order page. The confirmation of your order takes place simultaneously with the acceptance of the order immediately after sending an automated e -mail. The purchase contract is concluded with this e-mail confirmation.
2.4 Any agreements between the supplier and the customer must be in writing.
3. Scope of delivery
3.1 The scope of delivery and services in connection therewith shall be in accordance with the supplier's written order confirmation. Changes in the scope of delivery and services require a written agreement between the customer and the supplier.
3.2 The supplier shall retain unrestricted ownership and copyright of all documents delivered.
4. Price and shipping costs
4.1 The prices in the online shop include VAT and deliveries within the Netherlands. Daysy® and Teena® we also ship to Belgium. The price includes shipping costs. Prices are subject to change. The customer cannot claim a discount after an already purchased product.
4.2 Payment can only be made via the payment methods offered in the online shop. By entering into the instalment payment, the customer commits to paying the total amount in full in the respective instalments.
5. Terms of payment
5.1 The customer can choose from various payment methods in the shop.
5.2 In case of payment by advance invoice payment, we will send you our bank details with the order confirmation and deliver after receipt of payment.
6. Delivery conditions
6.1 Delivery takes place by GLS parcel service, in neutral packaging from our warehouse in Leusden. Our warehouse cannot receive and process returns. The buyer will receive the track & trace by e-mail on the day of dispatch to follow the package via the link.
If the shipment cannot be delivered because no one is found at the delivery address, the shipment will be returned to the depot (collection point). The addressee will be informed by the carrier by e-mail. If no response is received from the addressee within 5 working days, the consignment will be delivered to the sender. In this case, the supplier. The customer is responsible for collecting the delivery from the said alternative address. When the customer enters into a 'deposit agreement' with the carrier. 6.2 Delivery time is 3-5 working days. From Monday to Friday ordered before 12 noon goes in the post the same day otherwise the next day. We do not ship on weekends and public holidays. During holidays and extremely busy postal deliveries, it may take longer for the parcel to be delivered but usually the deliverer can be at your door the day after shipment. In case of delayed delivery of ordered products, the customer will be notified via e-mail by the supplier.
6.3 Upon shipment of the product, all benefits and risks are transferred to the customer.
7. Right of withdrawal
Consumers, have the right to cancel the purchase within 14 days of receipt under the following conditions:

The customer has the right to cancel the purchase within 14 days without giving any reason. Provided that the product has not yet been used. In the case of the LadyComp, the strip must not have been removed before use. The cycle trackers must not be personal internal use before return.

If the customer cancels the purchase, we (the supplier) will refund the payment we received from you. We may make a deduction from the refund for loss of value of goods delivered, if the loss is due to unnecessary handling by you. The supplier will make the refund to the same bank payment with which the transaction was made. We may refuse the refund if the goods have been put to use. The supplier will inform the customer and send the used goods to the customer.
Summary
The statutory trial period is 14 days. Products received must not have been used. Report info@daysy.nl within the trial period that you wish to cancel the order. Return the ordered products within 14 days to the address indicated by the supplier by e-mail. Ship with PostNL, the customer states on the package his/her name and address as sender. Carries the shipping costs to the supplier. The supplier emails about how the products were received and handles the refund if everything is received properly. The supplier will contact the customer by email about this.

Avoid damage to and contamination of the goods. If possible, return the goods in their original packaging with all accessories and all packaging parts. Use protective outer packaging. If you no longer have the original packaging, use suitable packaging that provides sufficient protection against possible transport damage.

The customer clearly states his/her name and address on the package. If the origin is unclear then we cannot process the package and cannot meet the refund.
8. Warranty and liability
8.1 The warranty is subject to statutory provisions.
8.2 The supplier is only liable for direct damages in case of gross negligence. Liability for medium and slight negligence is expressly excluded. Liability for indirect damages is also excluded. Limitations do not affect product liability claims by the customer. Limitations of liability do not apply to bodily injury, damage to health or loss of life of the customer.
9. Manufacturer's warranty
9.1 Warranty for Daysy®, LadyComp® and Teena® (hereinafter "device")
Device consists of modern materials and high-quality components developed and processed according to high quality standards. Each device has been checked and tested before being shipped to the customer. The manufacturer therefore guarantees that the device remains free from defects in materials or workmanship.
9.2 The warranty period starts on the day of sale of a new device from an authorised supplier to the original customer. A new owner of a second-hand appliance is not entitled to the manufacturer's warranty. The factory warranty is 2 years.
9.3 In case of technical defects, the manufacturer guarantees free repair or replacement of the device this after its own determination of the best option, once the defective product is returned to the manufacturer and received. Further claims, in particular for losses and damages, including consequential damages, are excluded. Indirect damage is not covered by the warranty.
9.4 Not covered by the warranty are damages resulting from improper use, cleaning or storage. The warranty is void by opening the device, causing damage to the device label or other external influences.
9.5 Warranty claims are only valid if the customer reports the defect to the supplier in writing immediately at info@daysy.nl within two weeks of discovery. The supplier will ask the customer to provide information necessary to consult with the manufacturer. Use must be discontinued after the realisation of the defect. The device must be returned to the supplier with PostNL provided with track & Trace code (email the code to info@daysy.nl). The supplier will provide by email the address to which you send the package.
10. Final provisions
The possible invalidity or ineffectiveness of one or more clauses of the current contract, for whatever reason, will not result in the invalidity or ineffectiveness of the current contract, and the rest of it remains valid and effective. If certain clauses are found to be invalid or unenforceable, they will be replaced by new valid clauses consistent with the legal and economic meaning of the invalid provision.
